Powers Pyles Sutter and Verville PC

THE POWER TO GUIDE YOU THROUGH THE REGULATORY MAZE IN EDUCATION

As a higher education law firm, Powers employs a practical, creative and collaborative approach to helping colleges and universities, vocational schools, investment firms, lenders, servicers, and others active in postsecondary education design and implement strategies to achieve their educational and operational goals in a compliant manner within a highly complex regulatory framework.

Education has emerged as a major area of national attention and public policy debate. Throughout the last decade, the federal government has significantly increased federal funding for the education and training of America's workforce. Increasingly, federal and state governments and consumers have called for higher levels of accountability from educational institutions for this significant investment. There is probably no more heavily reviewed and audited area of the education sector than the federal student financial aid programs.

This increased federal and state scrutiny has resulted in a complex regulatory framework affecting all sectors of postsecondary education which significantly impacts the administration of every college and university, from long-term strategic planning to day-to-day operations. Such a highly-regulated environment demands careful assessment and monitoring of internal risks and compliance. These changes also highlight the need for close monitoring of legislative and regulatory actions at the federal and state levels and a positive working relationship with the relevant regulatory agencies.

Higher Education Law Firm

As an education law firm in Washington, DC, attorneys and professionals at Powers Pyles Sutter & Verville work closely with educational institutions across the United States and abroad. Our clients include private nonprofit colleges and universities, public institutions of higher education, privately owned and publicly traded schools and school systems, secondary school systems, private equity firms, lenders, service providers and others active in postsecondary education. We advise our clients on matters pertaining to student financial aid and other areas of federal regulatory compliance, program review and audit resolution , accreditation compliance and proceedings, state licensure and approval requirements and proceedings, institutional substantive changes, financial responsibility concerns, mergers and acquisitions, administrative and judicial litigation, including False Claims Act and consumer protection matters, risk assessment and government relations.

Powers , an education law firm, has extensive and successful experience advising clients in connection with:

  • Defense and resolution of U.S. Department of Education program reviews and Office of the Inspector General audits
  • Establishing and maintaining institutional and programmatic eligibility to participate in the Title IV federal student assistance programs administered by the U.S. Department of Education under the Higher Education Act
  • Obtaining and maintaining accreditation from institutional and programmatic accrediting bodies
  • Addressing and resolving regulatory compliance issues, including with respect to the Higher Education Act, the Workforce Investment Act, veterans and other federal education funding programs, state educational licensing, institutional and programmatic accreditation, the Clery Act, and the Family Educational Rights and Privacy Act and other federal and state laws on student privacy.
  • Preventive and routine compliance reviews
  • Defense and resolution of claims before the U.S. Department of Education Office of Civil Rights

Law student volunteer, summer 2025.

The United States Attorney’s Office for the District of South Dakota investigates and prosecutes federal crimes and represents the interests of the United States in both criminal and civil cases and matters in U.S. District Court for the District of South Dakota, as well as in the Court of Appeals for the Eighth Circuit.

The office has three litigating divisions—Criminal, Civil, and Appellate.  The Criminal Division is concerned with the prosecution of all federal criminal violations, which include controlled substance violations, violent crime, organized crime, fraud, tax violations, white-collar crime, civil rights violations, crimes against children, and national security offenses. The Civil Division is devoted to cases involving bankruptcy, collections, affirmative civil enforcement, federal tort claim defenses, EEOC matters, and prisoner petitions. The Appellate Division handles the office’s appeals and provides guidance to AUSAs. Employees work from the Sioux Falls (headquarters), Rapid City, or Pierre offices.

As the federal agency whose mission is to ensure the fair and impartial administration of justice for all Americans, the Department of Justice is committed to fostering a diverse and inclusive work environment. To build and retain a workforce that reflects the diverse experiences and perspectives of the American people, we welcome applicants from the many communities, identities, races, ethnicities, backgrounds, abilities, religions, and cultures of the United States who share our commitment to public service.

The District of South Dakota is seeking outstanding candidates as Law Student Volunteers for the summer of 2025.  Law Student Volunteers are overseen by experienced Assistant U.S. Attorneys who provide daily supervision and coordinate work assignments.  The following are a few of the activities students experience in this role:

  • providing research on legal issues and stating their findings orally and/or through written memoranda;
  • assisting and/or preparing pre-trial and post-trial motions and responses;
  • assisting in the writing of trial and appellate briefs;
  • observing various stages of federal proceedings (witness interviews, depositions, trials, sentencings, appellate arguments, etc.);
  • assisting in the preparation of affidavits, exhibits, and notebooks for trial; and
  • for students who qualify under the student-practice rules, participating in court hearings.

Other opportunities provided to Law Student Volunteers include:

  • meeting with federal agencies (FBI, DEA, ATF, HSI, etc.);
  • attending “Intern Panels” hosted by Assistant U.S. Attorneys; and
  • receiving personal introductions to federal district judges.

The summer session runs from approximately June to August. For the best experience, Law Student Volunteers are expected to work in-person, 40 hours a week, for a minimum of 8 weeks.

To be eligible as a Law Student Volunteer, ALL of the following requirements must be met:

• Law Student Status: Acceptance of applications for this announcement will be limited to first-year (second semester), second and third-year law students. Law school graduates are not eligible for Law Student Volunteer positions. An eligible student is an individual who is enrolled in law school pursuing a Juris Doctor Degree and is taking at least half-time academic course load in an accredited university. Successful candidates must have outstanding academic records, superior writing skills, and be in good academic standing.

• Citizenship:  Law Student Volunteers must be United States citizens or owe permanent allegiance to the United States.(Currently, natives of American Samoa, Swains Island and certain inhabitants of the Commonwealth of the Northern Mariana Islands are the only groups that owe permanent allegiance to the United States.)

• Background Investigation: All Law Student Volunteers must successfully complete a background investigation to determine suitability for a Federal Law Student Volunteer experience.

• Volunteer Agreement: All Law Student Volunteers are required to sign the Participant Agreement (will be completed later during the security process, if selected).

Please provide the following information  as one combined PDF attachment  to: [email protected]  no later than midnight August 12, 2024.

  • Cover letter including your contact information, the litigating division(s) you are interested in, office preference (Sioux Falls, Rapid City, and/or Pierre), and the dates you are available for the Law Student Volunteer position.  We encourage you to addresses your interest in the USAO’s work and your ties to (or interest in) the District of South Dakota
  • Current resume
  • Current law school transcript (unofficial).  If your  most recent semester's  grades are unavailable when you submit your application, you must provide them as soon as they become available
  • A legal writing sample (not to exceed 10 pages).

Those selected for interviews will be notified.  We typically participate in on-campus interviewing (OCI) at the University of South Dakota Knutson School of Law.  For students farther afield and when on-campus interviews are not feasible, arrangements will be made for interviews online or in person at the U.S. Attorney’s Office in Sioux Falls.

This is a voluntary position without compensation or benefits.  Academic credit may be available. Law Student Volunteers are required to coordinate their eligibility and any associated requirements through their respective law school at least one month in advance.

Department Policies

Equal Employment Opportunity :  The U.S. Department of Justice is an Equal Opportunity/Reasonable Accommodation Employer.  Except where otherwise provided by law, there will be no discrimination because of race, color, religion, national origin, sex - including gender identity, sexual orientation, or pregnancy status - or because of age (over 40), physical or mental disability, protected genetic information, parental status, marital status, political affiliation, or any other non-merit based factor.  The Department of Justice welcomes and encourages applications from persons with physical and mental disabilities. The Department is firmly committed to satisfying its affirmative obligations under the Rehabilitation Act of 1973, to ensure that persons with disabilities have every opportunity to be hired and advanced on the basis of merit within the Department of Justice. For more information, please review our full  EEO Statement .

Reasonable Accommodations :  This agency provides reasonable accommodation to applicants with disabilities where appropriate. If you need a reasonable accommodation for any part of the application and hiring process, please notify the agency.  Determinations on requests for reasonable accommodation will be made on a case-by-case basis.

Outreach and Recruitment for Qualified Applicants with Disabilities :  The Department encourages qualified applicants with disabilities, including individuals with targeted/severe disabilities to apply in response to posted vacancy announcements.  Qualified applicants with targeted/severe disabilities may be eligible for direct hire, non-competitive appointment under Schedule A (5 C.F.R. § 213.3102(u)) hiring authority.  Individuals with disabilities are encouraged to contact one of the Department’s Disability Points of Contact (DPOC) to express an interest in being considered for a position. See list of  DPOCs .

Suitability and Citizenship :  It is the policy of the Department to achieve a drug-free workplace and persons selected for employment will be required to pass a drug test which screens for illegal drug use prior to final appointment.  Employment is also contingent upon the completion and satisfactory adjudication of a background investigation. Congress generally prohibits agencies from employing non-citizens within the United States, except for a few narrow exceptions as set forth in the annual Appropriations Act (see,  https://www.usajobs.gov/Help/working-in-government/non-citizens/ ). Pursuant to DOJ component policies, only U.S. citizens are eligible for employment with the Executive Office for Immigration Review, U.S. Trustee’s Offices, and the Federal Bureau of Investigation. Unless otherwise indicated in a particular job advertisement, qualifying non-U.S. citizens meeting immigration and appropriations law criteria may apply for employment with other DOJ organizations. However, please be advised that the appointment of non-U.S. citizens is extremely rare; such appointments would be possible only if necessary to accomplish the Department's mission and would be subject to strict security requirements. Applicants who hold dual citizenship in the U.S. and another country will be considered on a case-by-case basis. All DOJ employees are subject to a residency requirement. Candidates must have lived in the United States for at least three of the past five years. The three-year period is cumulative, not necessarily consecutive. Federal or military employees, or dependents of federal or military employees serving overseas, are excepted from this requirement. This is a Department security requirement which is waived only for extreme circumstances and handled on a case-by-case basis.

Veterans :  There is no formal rating system for applying veterans' preference to attorney appointments in the excepted service; however, the Department of Justice considers veterans' preference eligibility as a positive factor in attorney hiring. Applicants eligible for veterans' preference must include that information in their cover letter or resume and attach supporting documentation (e.g., the DD 214, Certificate of Release or Discharge from Active Duty and other supporting documentation) to their submissions. Although the "point" system is not used, per se, applicants eligible to claim 10-point preference must submit Standard Form (SF) 15, Application for 10-Point Veteran Preference, and submit the supporting documentation required for the specific type of preference claimed (visit the OPM website,  www.opm.gov/forms/pdf_fill/SF15.pdf  for a copy of SF 15, which lists the types of 10-point preferences and the required supporting document(s). Applicants should note that SF 15 requires supporting documentation associated with service- connected disabilities or receipt of nonservice-connected disability pensions to be dated 1991 or later except in the case of service members submitting official statements or retirement orders from a branch of the Armed Forces showing that their retirement was due to a permanent service-connected disability or that they were transferred to the permanent disability retired list (the statement or retirement orders must indicate that the disability is 10% or more).

USAO Residency Requirement :  Assistant United States Attorneys must reside in the district to which appointed or within 25 miles thereof.  See 28 U.S.C. 545 for district specific information.

This and other vacancy announcements can be found under  Attorney Vacancies  and  Volunteer Legal Internships . The Department of Justice cannot control further dissemination and/or posting of information contained in this vacancy announcement. Such posting and/or dissemination is not an endorsement by the Department of the organization or group disseminating and/or posting the information.

What to Know About Kamala Harris’s Husband, Doug Emhoff

Doug Emhoff, in a suit and blue tie, sitting on a couch.

By Zach Montague

Reporting from Washington

Doug Emhoff, the second gentleman, would become the country’s first-ever first gentleman if Vice President Kamala Harris were to win the presidency in November.

Over the past three and a half years, Mr. Emhoff has cultivated a small policy portfolio reflecting his identity as the first Jewish spouse of a vice president or president and his 30-year career as an entertainment lawyer.

As the husband of the first woman to be vice president, Mr. Emhoff has spoken openly about the joys and challenges of taking a supporting role in his marriage and how he has looked for pathways to do meaningful public service work.

Shifting gears to focus on family

Mr. Emhoff, 59, was born in Brooklyn and raised in Matawan, N.J., before his family moved to California when he was a teenager. He attended college and law school in Los Angeles and rose through the ranks of major law firms, including Venable and DLA Piper , where he became a partner and earned as much as $1.2 million per year, before stepping away in 2020 to avoid conflicts of interest.

He and Ms. Harris married in 2014, and while Mr. Emhoff delights in sharing stories of their courtship and relationship, he has also described ambivalence about pausing his career, and his search for avenues to make an impact through public service.

“I miss it every day,” he told the New York Times reporter Katie Rogers in her book “ American Woman .”
